2023 Elections: Court Fixes Date For Judgement In Suit Seeking Voting Without PVC
Justice Binta Nyako of the Federal High Court in Abuja has set January 30 as the deadline for a decision in a suit filed against the Independent National Electoral Commission (INEC).
The plaintiffs, Barrister Emmanuel Chukwuka and Bruno Okeahialam, are seeking an order compelling INEC to either issue permanent voter cards (PVCs) to registered voters or allow them to use temporary voter cards or the Voter Identification Number (VIN) during the 2023 general elections.

A civil society organization filed the suit on behalf of 29 million registered voters who they claim will be disenfranchised in next month’s elections.

The plaintiff seeks a declaration that all persons who have properly registered as voters with INEC and whose names appear on the defendant’s register should not be denied the right to vote in the upcoming general elections.
During the day’s proceedings, the plaintiff stated that an INEC statement acknowledged that insecurity and attacks on its offices resulted in the loss of PVCs in several states.
However, INEC counsel argued that the plaintiff’s case is speculative, and that the Commission had extended the deadline for collecting PVCs.
He also wondered why the application was submitted when PVC collection was still ongoing.
Justice Binta Nyako, the presiding judge, agreed it is a serious matter because some people in her household cannot and have not collected their PVCs.
She subsequently fixed January 30 for judgement.
