France Enacts Law To Safeguard Children From Suspected Abusive Parents
France has taken a significant step in protecting children from potential abuse by passing legislation aimed at addressing cases of incest and domestic violence within families.
The National Assembly approved the bill on Monday, March 11, followed by the Senate passing their version on Tuesday.
Previously, the legal system often left children vulnerable to potential harm, including being in the custody of an alleged abuser during lengthy investigations.
Under the newly enacted law, parents under investigation for suspected sexual abuse or any other crime against their child will automatically have all their parental rights suspended. This includes the ability to care for or have contact with their child.
Furthermore, if a parent is convicted of sexual abuse against their child or any crime involving the child or the other parent, their parental rights will be completely revoked, unless a judge provides a justified exception.
In some cases, the parent may not even be informed about significant events in their child’s life.
Justice Minister Eric Dupond-Moretti emphasized the importance of protecting children who are victims of parental abuse.
Experts from the United Nations have highlighted instances where children allegedly at risk of abuse are placed in the custody of the accused parent, while the other parent is penalized for attempting to safeguard the child.
According to CIIVISE, a government commission for the protection of sexual abuse victims, approximately 160,000 children in France fall victim to sexual assault each year. Additionally, 5.5 million French adults report experiencing sexual abuse during their childhood, with men comprising 95 percent of the perpetrators.
