The Supreme Court has rejected Emeka Ihedioha’s application, a member of the Peoples Democratic Party (PDP) in Imo State, seeking a certificate of return as the legitimate Governor of Imo State.

The court, in a ruling delivered by Justice Tijjani Abubakar on Tuesday, dismissed the application as lacking merit, deeming it unnecessary and vexatious.

The court imposed a cost of N40 million against Mike Ozekhome for presenting the matter, and the recipients of the payment include the Action People’s Party (APP), Uche Nnadi, Uche Nwosu, and the Independent National Electoral Commission (INEC).

The motion, considered frivolous by the court, was brought by Ozekhome, who sought a consequential order compelling INEC to issue a fresh Certificate of Return to Ihedioha, allowing him to serve a four-year tenure as the Governor of Imo State. Ozekhome argued that Senator Hope Uzodimma unlawfully spent the four years that Ihedioha should have served.

The motion claimed that the All Progressives Congress (APC) had no candidate in the 2019 Imo Governorship election, and Uzodimma should not have been made governor on the APC platform.

However, the Supreme Court rejected the motion, citing a lack of jurisdiction and characterizing it as strange, frivolous, baseless, unwarranted, and vexatious, intended to mock the Supreme Court.
