JUST IN: Court Deliver Ruling On Request Seeking To Vacate Order Restraining Labour Party Chairman, Others From Parading As National Officers

High Court of the Federal Capital Territory (FCT) has declined a request to vacate its interim order restraining the National Chairman of the Labour Party (LP), Julius Abure and three other senior officials of the party from further parading themselves in that capacity.

Justice Hamza Muazu, in a ruling on Monday, rejected the request by the lawyer to Abure and others, Alex Ejesieme (SAN) for the vacation of the order made on April 5.

The National Secretary, Alhaji Farouk Ibrahim; National Treasurer, Oluchi Opara; National Organising Secretary, Clement Ojukwu from further parading themselves as officials of the party.

The judge ordered that the restraining order, made ex-parte, shall subsist, pending the hearing and determination of a motion on notice for interlocutory injunctions.

The ruling was on a motion ex-parte marked: M/7082/2023 filed along with the substantive suit instituted by the eight aggrieved members, including the Chairman of the party in Abure’s ward – Ward 03, Arue, Esan North-East Local Government of Edo State, Martins Esikpali John O. and the party’s Publicity Secretary, Abayomi Arabambi.

At the resumption of proceedings on Monday, Ejesieme said he has filed an application querying the court’s jurisdiction to hear the case.

He urged the court to reverse the April 5 order, stating that the claimants invaded the LP secretariat and vandalized it.

Ejesieme said the court ought to intervene before “more havoc is done to Nigeria’s nascent democracy.

LP’s National Legal Adviser, Akingbade Oyelese, who represented the party, said the party was not yet served with any processes relating to the suit.

Oyelese said he was ready to collect the processes from other parties.

The lawyer to the claimants, George Ibrahim, claimed that the defendants were yet to obey the April 5 order.

Ibrahim told the court that Abure and others were still parading themselves as national officers of the LP.

Ruling, Justice Muazu elected to hear the defendants’ preliminary objection and ordered parties to serve their processes on the fifth defendant, who shall reply within eight days.

He then adjourned till April 20.

Other plaintiffs in the case are: Lucky Shaibu, Isah Zekeri, Omogbai Frank, Abokhaiu Aliu, Ayohkaire Lateef and Joe Elomah.
