Stolen Mandates Saga: PDP Heads to Court as Exodus of Lawmakers Shakes Nation

A heated political showdown is brewing in Nigeria as the Peoples Democratic Party (PDP) ramps up its fight to reclaim what it describes as “stolen mandates,” following a surge of defections to the ruling All Progressives Congress (APC).

With 82 lawmakers—from both federal and state legislatures—defecting, many to the APC, the PDP is grappling with one of its most severe internal crises since it lost national power in 2015. Among the most stunning developments is the defection of Delta State Governor Sheriff Oborevwori to the APC, a move seen as a major blow to PDP’s political dominance in the South-South region.

This dramatic turn has triggered an aggressive legal push by the opposition party. After a marathon six-hour meeting of its National Working Committee (NWC) in Abuja, PDP leaders resolved to challenge the wave of defections in court, branding them a blatant hijacking of mandates won under the PDP platform.

Legal Counterattack Amid Growing Tensions

In what observers call a potential turning point for Nigeria’s party politics, the PDP is set to argue that elected mandates belong to political parties—not individuals. The party is anchoring its case on Section 68(1)(g) of the 1999 Constitution (as amended), which states that lawmakers who defect without a division in their party must forfeit their seats.

The PDP’s bold move to apply this clause to a sitting governor, Oborevwori, pushes the battle into uncharted constitutional territory, as courts have yet to definitively rule on reclaiming executive mandates under this provision.

The party’s legal strategy is being quietly coordinated by National Legal Adviser Kamaldeen Ajibade, who sources say is spearheading a mission to safeguard the PDP’s institutional credibility. However, as of the weekend, no official court filings have been submitted, leaving both the public and political observers anxiously waiting.
