Tribunal Delivers Ruling On Nnamani’s Petition Against Election Of Senator Kelvin Chukwu Of Labour Party
The National Assembly Election Petitions Tribunal in Enugu State has dismissed the petition brought forth by Senator Chimaroke Nnamani of the Peoples Democratic Party (PDP), contesting the victory of Senator Kelvin Chukwu from the Labour Party.
Nnamani, a former Enugu State governor from 1999 to 2007, represented the Enugu East Senatorial district in the 9th Assembly under the PDP banner. Despite securing the PDP nomination to run for the Senatorial seat in the February 25 national assembly election, he openly supported the All Progressives Congress presidential candidate, Bola Tinubu, against his own party’s candidate, Atiku Abubakar.

Following his expulsion from the PDP, Nnamani still ran under the party’s banner but ultimately lost to the Labour Party’s candidate, Kelvin Chukwu. INEC declared Chukwu the winner of the Enugu East Senatorial district election with 69,000 votes, surpassing Nnamani’s total of 49,000 votes.
Nnamani alleged that the election was tainted by over-voting, irregularities, malpractices, and non-compliance with electoral guidelines. He sought a court declaration of his rightful victory or an invalidation of the poll results.
In its verdict delivered on Wednesday, the tribunal affirmed Senator Kelvin Chukwu’s win. Additionally, the tribunal imposed a cost of N500,000 on the petitioners in favor of the three respondents: Kelvin Chukwu, the Labour Party, and INEC. The three-member panel, led by Justice Nusirat I. Umar, unanimously dismissed the petition, citing its vagueness, lack of merit, incompetence, generality, and academic nature.
