The updated rules, issued by the Department of Homeland Security, eliminate duty-free privileges for certain products valued at $800 or below, known as the “de minimis” exemption. This change comes amid concerns that the exemption is being exploited, particularly by Chinese e-commerce giants like Shein and Temu, which flood US ports with low-priced goods.
“Over the past decade, the volume and value of low-value shipments have surged, undermining American businesses and workers,” said Homeland Security Secretary Alejandro Mayorkas. “These changes will strengthen the nation’s economic foundation and protect against potential security risks.”
From 2015 to 2023, shipments under this exemption skyrocketed from 139 million to over a billion, prompting calls for stricter controls. The move also addresses challenges in screening these imports for illicit substances, such as synthetic drugs, often concealed in low-value packages.
The new rule excludes products subject to Section 301 tariffs, which primarily affect Chinese textiles and apparel, as well as Section 232 tariffs on steel and aluminum goods. By tightening these rules, the government seeks to limit the volume of duty-free imports and safeguard domestic industries.
National Economic Advisor Lael Brainard criticized Chinese-founded platforms for exploiting trade rules to gain an unfair advantage. The crackdown comes as lawmakers and policymakers push for reforms to close what they call a “trade loophole.”
Customs and Border Protection (CBP) highlighted that low-value shipments pose risks similar to higher-value ones but are harder to monitor due to limited data and their sheer volume.
The reforms are expected to take full effect under the incoming administration of President-elect Donald Trump, who has vowed to continue the focus on securing US economic interests.
