What To Know As Tinubu Faces Fresh Legal Hurdle At Supreme Court

President Bola Ahmed Tinubu has found himself entangled in a legal battle before the Supreme Court over allegations of unlawfully inaugurating himself as President despite an ongoing legal challenge against the conduct of the 2023 presidential election, as reported by the News Agency of Nigeria (NAN).

Albert Ambrose Owuru, a presidential candidate in the 2019 general election, has invoked the doctrine of lis pendens and petitioned the apex court to annul Tinubu’s inauguration as the winner of the 2023 presidential poll. Owuru, who is also a constitutional lawyer, argues that the presidential election that led to Tinubu’s victory was an exercise in futility and an illegal act of self-help, given the unresolved lawsuit against Tinubu and others at the Supreme Court.

The ongoing Supreme Court case (No. SC/667/2023) features A.A. Owuru and Hope Democratic Party (HDP) as appellants, with former President Muhammadu Buhari, the Attorney General of the Federation, Independent National Electoral Commission, and Tinubu as respondents. Owuru contends that Tinubu’s declaration as President by INEC undermines the Supreme Court and established law due to lis pendens. He argues that Tinubu, being a party in the pending suit before the apex court, should not have presented himself for inauguration in connection with any presidential poll.

Owuru, who contested the 2019 presidential election under the HDP banner against former President Buhari, claims to have been adjudged the winner of the poll despite INEC’s declaration of Buhari. Tinubu voluntarily joined the ongoing suit on May 18 this year as an interested party.

In a recent motion on notice served to Tinubu through Wole Olanipekun’s chambers, the former presidential candidate seeks an order from the Supreme Court restraining the respondents, particularly Tinubu, from further accessing the federation account until the constitutional questions surrounding the 2023 election are resolved.
