BREAKING: Court Annuls Powerful PDP Chieftain Senatorial Ticket (PHOTO)

The Federal High Court I, sitting in Yola, has annulled the Peoples Democratic Party’s senatorial primary for Adamawa Central Senatorial District, which was won by Aminu Iya-Abbas, Speaker of the Adamawa State House of Assembly.

In his decision on Mohammed Modibbo vs. the Peoples Democratic Party and four others, Justice Abdulaaziz Anka ruled that the PDP’s senatorial primary elections in Adamawa Central were invalid.

The participation of the fourth defendant, Alhaji Auwal Tukur, Chairman of the Governing Council of Adamawa State University, as a political appointee without compliance with the new Electoral Act 2022, the judge ruled, violated the process, and thus “the entire process is hereby null and void.”

He said, “The only issue proved before the court is as regards the fourth defendant’s engagement in the primary election conducted, him being a political appointee i.e chairman governing council Adamawa State University, Mubi, accordingly, the entire process is hereby nullified by this honourable court. The consequence, of which the party, will not be able to field a candidate for the general election come 2023 because of substantial non-compliance with the Electoral Act 2022. This is the consequential judgement of the court, against the entire political party and it’s members.”

Iya-Abbas, the speaker of the Adamawa State House, defeated Tukur, the son of former PDP chairman Babanga Tukur, and five other aspirants, including Barrister D. D. Azura, Mohammed Modibbo, Ibrahim Mustapha, Ibrahim Abubakar, and Hon. Abdullahi Prambe, to win the PDP senatorial ticket for Adamawa Central Senatorial District.

Dissatisfied with the outcome of the primary, Modibbo filed a lawsuit challenging the primaries’ conduct, specifically whether Auwal Tukur, as a political appointee who had not resigned, was eligible to participate in the primaries.

As a result, the court voided the election in its ruling, citing Tukur’s participation in the PDP senatorial primary as a violation of the Electoral Act 2022.
