Cross River North: See What The Court Did To Ayade’s Candidacy

The Federal High Court in Abuja has confirmed Governor Ben Ayade as the All Progressives Congress (APC) senatorial candidate for Cross River North.

Cecilia Odey’s suit against the Governor was dismissed by the Court presided over by Justice Nkeonye Evelyn Maha.

Cecilia of the APC ran in the APC’s May 28th Cross River State Northern Senatorial District primaries, but was defeated by Martins Orim.

She later filed a lawsuit challenging the APC’s new primaries on July 14, 2022, following the voluntary withdrawal of Martins Orim for Ayade in accordance with S. 31 and 33 of the 2022 Electoral Act

While dismissing the plaintiff’s case, the court stated that Cecilia’s claim was not in accordance with the provisions of the Electoral Act, APC guidelines, and the Federal Republic of Nigeria constitution and could not be proven by any material fact.

It also rejected the argument that the new primaries were re-run elections rather than by-elections.

The court also stated that the requirement of giving notice under the Electoral Act is to notify INEC rather than the plaintiff (Cecilia).

Attempts to elicit responses from the plaintiff and its lawyer were futile in determining the plaintiff’s next course of action.

However, APC Publicity Secretary in Cross River, Erasmus Ekpang, stated that the governor’s victory was expected because he is the most popular candidate for the party.

“Cecilia has not been on the ground, and there was no way she would have emerged as a candidate,” he says. What she should have done is accepted her defeat in good faith. We are pleased with the decision, which represents a victory for the APC.”
