High Court Overrules APC Leadership In Benue, Cites Justice Violations

The committee, inaugurated by APC National Chairman Dr. Abdullahi Ganduje on August 21, 2024, was tasked with a six-month mandate following the dissolution of the Austin Agada-led State Working Committee (SWC). However, the dissolution was challenged in court by Agada and eight others, citing violations of the APC and Nigerian constitutions.

In his ruling, Justice Kume stated that the dissolution of the SWC violated Section 36 of the Nigerian Constitution and Article 21:1 of the APC Constitution, as the members were not afforded fair hearing. He compared the situation to God’s judgment of Adam in the Garden of Eden, emphasizing the importance of justice and fairness.

As a result, the court nullified the caretaker committee’s actions and declared its constitution invalid.

Reactions to the Judgment

Benjamin Omale, chairman of the dissolved committee, expressed disappointment and announced plans to appeal. “We have instructed our legal team to seek a stay of execution on the judgment and pursue justice in the Court of Appeal,” Omale said.

Meanwhile, APC has officially appealed the ruling at the Makurdi Division of the Court of Appeal and requested a stay of execution to prevent enforcement of the High Court’s judgment.

The party has urged its supporters to remain calm as the legal process unfolds.
