Kanu’s legal team, led by Aloy Ejimakor, described the ongoing trial as a politically motivated persecution and an act of state-sanctioned extrajudicial detention.
The lawyers highlighted that since requesting Justice Binta Nyako to recuse herself due to alleged bias and violations of a Supreme Court ruling, the judiciary has not reassigned the case to another judge. They further accused the federal government of disregarding both domestic and international court orders concerning Kanu’s rights and those of his supporters.
Key grievances include the delay in hearing three pending appeals on Kanu’s bail reinstatement and the alleged illegal rendition of Kanu from Kenya. The defense team also criticized the federal government for actions such as the military invasion of Kanu’s residence in 2017, the proscription of IPOB, and frequent amendments to the charges against him.
Addressing the trial court’s refusal to grant bail despite a Supreme Court directive, Ejimakor questioned its impartiality:
“Do you expect Mazi Nnamdi Kanu to subject himself to trial before a judge whom the Supreme Court has declared biased and who shows no readiness to change?”
Kanu’s legal troubles date back to his 2015 arrest on charges including treasonable felony, illegal importation of broadcast equipment, and defamation of then-President Muhammadu Buhari. Although granted bail in 2017, he fled the country following a military raid on his residence, which reportedly resulted in numerous casualties.
The defense team maintains that Kanu’s continued detention undermines judicial integrity and the rule of law. They call for adherence to legal standards to ensure a fair and transparent resolution to the case.
