The ruling came after separate appeals were filed by Senator Esther Usman, the caretaker committee, and the Independent National Electoral Commission (INEC). Justice Barka emphasized that the court did not address the Labour Party’s internal leadership disputes, deeming them non-justifiable.

The court also declared that any actions taken outside its jurisdiction are void. Consequently, it struck down the Federal High Court’s ruling from October 8, 2024, which had questioned Abure’s position, citing a lack of jurisdiction.

This decision came amid a leadership crisis in the Labour Party, which arose following the 2023 general elections. The party’s National Executive Committee had removed Abure, subsequently appointing a caretaker committee led by Senator Esther Usman. The committee was formed after a stakeholders’ meeting convened by Abia State Governor, Alex Otti, in Umuahia.
