JUST IN: Emefiele Takes Fresh Action To Stop Prosecution (DETAILS)

He also seeks an order from the court to dismiss all offenses leveled against him by the Government, which he claims is in open defiance of the existing court orders that granted him bail on July 25, 2023.

Emefiele, represented by his legal team led by Senior Advocate of Nigeria, Joseph Daudu, has filed an application with the Vacation judge, Justice Nicholas Oweibo. The suspended CBN Governor invoked Section 6(6)(a) of the 1999 Constitution (as amended), pertinent sections of the Administration of Criminal Justice Act, 2015, and the inherent powers of the court in this application.

Emefiele seeks an order from Justice Oweibo to halt ongoing proceedings in his current case until he exhausts all legal avenues available to compel the government and the Department of State Services (DSS) to adhere to the court’s bail order or to detain him in the custody of the Nigerian Correctional Center until he fulfills his bail conditions.

One of his defense team members, Senior Advocate of Nigeria, Victor Opara, confirmed that the application was filed on August 8 and has been served to the Federal Government.

Emefiele’s application aims to assert the court’s authority and protect the integrity of its orders, while also upholding the rule of law in the democratic system.

It has come to light that the Federal Government had filed an application last week seeking permission to appeal against the bail granted to the suspended CBN governor. Justice Oweibo has set a hearing date for the government’s application on August 10.

In the application submitted on August 3 by a deputy director of public prosecutions of the Federation, Nkiru Jones-Nebo, the Federal Government also requested the court to suspend the order remanding Emefiele in the custody of the Nigeria Correctional Services and instead place him under the custody of the DSS.
