The Supreme Court, in its decision, highlighted that the respondent’s claim that the 165,616 ballot papers were not from the Independent National Electoral Commission (INEC) lacked proof.

The court emphasized that, according to section 63(1) of the Electoral Act, a ballot paper can only be declared invalid if it is proven not to have been given to the presiding officer.

Justice Okoro argued that, in this instance, the contested ballot papers were signed and stamped, with the only missing element being the date. Consequently, 165,616 votes should be added to Abba Yusuf’s total.

Additionally, the Supreme Court ruled that the matter of the wrong nomination of Governor Yusuf is a pre-election issue, and no political party has the authority to interfere with how another party selects its candidates.

In response to the Supreme Court’s decision, Sowore suggested that the powers that be did not genuinely want to confirm Yusuf as the winner of the March 18 governorship election in Kano State.
