South African Court Greenlights Extradition Of Alleged Nigerian ‘Romance Scammers’ To Face US Trial

According to a statement by the National Prosecuting Authority (NPA), the court ruling affirms that there is substantial evidence warranting the prosecution of the accused individuals. Among them are Perry Osagiede, Enorense Izevbiege, Franklin Edosa Osagiede, Osariemen Eric Clement, Collins Owhofasa Otughwor, Musa Mudashiru, and Prince Ibeabuchi Mark.

While the court decision paves the way for extradition, Toritseju Gabriel Otubu, one of the accused, has successfully petitioned to have his extradition inquiry handled separately from his co-defendants. A ruling on his case is expected on April 12, 2024.

The accused individuals face a litany of charges, including wire fraud conspiracy, wire fraud, money laundering conspiracy, and aggravated identity theft, under US federal law.

The prosecution alleges that the syndicate, operating collectively, engaged in fraudulent activities targeting victims through email and social media platforms, including online dating sites. Using false identities, they purported to be professionals working on projects in South Africa, convincing victims to send money or facilitate financial transactions to South Africa under false pretenses.

The legal proceedings commenced in January 2022, with all eight respondents initially represented as a single case. However, after contentious legal arguments regarding the admissibility of evidence from the US, Otubu’s request for a separate hearing was granted.

Following rigorous prosecution efforts and a thorough examination of the evidence, the court has upheld the extradition request, ordering the accused to be remanded in Pollsmoor Prison pending a decision by the Minister of Justice and Correctional Services on their surrender. The accused have the option to appeal the court’s decision within 15 days.

The Western Cape Director of Public Prosecutions commended the prosecution team for their dedication in pursuing justice for the victims and ensuring the extradition inquiry reached a satisfactory conclusion.
