The ruling came in response to an appeal filed by Aisha Dahiru, the gubernatorial candidate of the All Progressives Congress (APC). The five-member panel, led by Justice John Okoro, dismissed the appeal, declaring it lacking in merit.

The judgment specifically criticized the actions of the Resident Electoral Commissioner (REC), Hudu Ari, denouncing them as “irresponsible and criminal.” The criticism stems from the controversy surrounding the announcement of election results in Adamawa State.

Justice Okoro emphasized the exclusive responsibility of the returning officer in declaring election results, according to the Electoral Act. Underlining the significance of this protocol, he stressed its importance in preventing chaos and anarchy during the electoral process.
