Trump Faces Sentencing After Supreme Court Denies Delay In Hush Money Case

The court ruled that the likely sentence of an “unconditional discharge” would not interfere with Trump’s presidential transition, and that any evidentiary issues raised by his legal team could be addressed through regular appeals. This ruling came after a New York appeals court judge also rejected a request to pause the sentencing.

The one-page order revealed that Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh dissented, while Chief Justice John Roberts and Justices Sonia Sotomayor, Elena Kagan, Amy Coney Barrett, and Ketanji Brown Jackson voted to keep the sentencing on track.

Trump’s lawyers argued that, as president-elect, sentencing should be delayed. They also claimed that the trial court improperly admitted certain evidence that was barred by a previous Supreme Court decision granting presidents immunity for actions taken in official capacity. In response, New York officials argued that Trump was a private citizen at the time the charges were filed and that delaying sentencing was unnecessary as state-level appeals had not been exhausted. They also noted that the judge planned to impose an unconditional discharge, which would result in a felony conviction without additional penalties.

Trump was convicted in May on 34 felony counts of falsifying business records related to efforts to conceal hush money payments to adult film actress Stormy Daniels. Trump’s other two federal criminal cases have been paused following his election victory, while a Georgia election interference case is stalled after a state appeals court disqualified the prosecutor.

Sentencing for the hush money case is scheduled for Friday.
