Shaibu’s legal representative cited an interlocutory injunction from an Abuja Federal High Court, postponing the proceedings to April 8, 2024. While Shaibu’s camp emphasizes adherence to the court ruling, the House of Assembly’s counsel contends that constitutional provisions support the panel’s activities.
The inquiry into allegations of misconduct against Edo State’s Deputy Governor, Comrade Philip Shaibu, has encountered a significant development as Shaibu’s legal team has opted to suspend his involvement in the proceedings. The decision, rooted in an interlocutory injunction from an Abuja Federal High Court, postpones further actions until April 8, 2024.
Representing Shaibu, Professor Oladoyin Awoyale (SAN) highlighted the imperative nature of adhering to the court’s ruling, underscoring concerns that the panel’s continued proceedings might preempt the court’s decision.
In response, the House of Assembly’s counsel, Ohiafi Joe, contended that constitutional mandates empower the panel’s activities, asserting that no court directive can obstruct the House and the panel from executing their constitutional obligations.
As legal arguments unfolded during the session, the panel, chaired by retired Justice S. A. Omonuwa, confronted the complexity of legal procedures, particularly concerning citation methods in legal submissions. Professor Awoyale’s reliance on electronic citations from the Law Pavilion Electronic Law Reports triggered a debate on procedural correctness, prompting panel member Professor Theresa Akpoghome to question the validity of verbal citations in the absence of physical documentation.
Navigating these legal intricacies, the panel resolved to deliberate on the arguments presented, emphasizing the need to consider the implications of the Abuja Federal High Court’s directive for the involved parties to demonstrate cause.
As the investigation into Shaibu’s alleged misconduct unfolds, stakeholders await further developments amidst legal maneuvering and procedural scrutiny.
