Appeal Court Dismisses Yahaya Bello’s Contempt Case Against EFCC BossIn a significant legal development, the Court of Appeal in Abuja has ruled in favor of the Economic and Financial Crimes Commission (EFCC) and its Chairman, Ola Olukoyede, dismissing a case brought against them by former Kogi State Governor Yahaya Bello.
Justice Joseph O.K. Oyewole delivered the lead judgment, asserting that no court can prevent law enforcement agencies like the EFCC from carrying out their statutory duties of investigating and prosecuting crimes. The judgment emphasized the foundational principle of separation of powers, essential to the functioning of a democratic society.
The dispute arose from an order by Justice Isa Jamil of the Kogi State High Court, which summoned Olukoyede to defend allegations of disregarding court orders. Additionally, the lower court had restrained the EFCC from arresting or detaining Bello pending the outcome of a substantive suit.
The appellate court’s decision overturned these directives, allowing the EFCC to proceed with its legal actions against Bello and imposing a fine of One Million Naira (N1,000,000.00) against the former governor.
Justice Oyewole underscored the court’s duty to avoid technicalities and upheld the EFCC’s appeal, asserting its authority to continue pursuing the case against Bello without hindrance.
The ruling marks a critical juncture in the legal battle between Bello and the EFCC, underscoring broader implications for the enforcement of judicial decisions and the autonomy of law enforcement agencies in Nigeria.
