In the lawsuit with reference number FHC/ABJ/CS/1027/2023, Phillip Shaibu has accused Edo Governor, Godwin Obaseki, of conspiring to withdraw his security personnel and orchestrate his impeachment.
His plea to the court includes a request to prevent the Governor and other defendants from obstructing his official duties, including attempting to impeach him.
Among the defendants in the case are the Inspector General of Police (IGP), the State Security Service (SSS), the Governor of Edo State, the Speaker of Edo State House of Assembly, and the Chief Judge of Edo State.
During the recent court session on Thursday, Justice Ahmed Mohammed noted that only three out of the five defendants had adhered to a previous order to demonstrate why the plaintiff’s request for interlocutory injunctions should not be granted.
Upon an oral request made by the legal representative of the SSS, I. Awo, to seek additional time for his client to comply with the order, Justice Mohammed postponed the proceedings to August 22. This extension is intended to provide sufficient time for all the defendants to explain their positions and potentially proceed with the hearing of the substantive case, provided that all necessary legal procedures were duly submitted.
Justice Mohammed directed the issuance of a hearing notice to the IGP, who had not adhered to the order to show cause and was also not represented by a lawyer in court.
As a result, Justice Muhammed instructed all parties to maintain the status quo ante bellum until the next scheduled court date.
