Breaking: Court Stops-Controversial Tariff-Hike By Ikeja-Electric And NERC (View-Details)

The Federal High Court in Lagos has issued an interim injunction preventing Ikeja Electric PLC and the Nigerian Electricity Regulatory Commission (NERC) from implementing a controversial tariff increase on “Band A” feeders. The decision follows an ex-parte application filed by Rida National Plastics Limited, challenging the tariff hike announced on April 4 and May 6, 2024.

Justice Chukwujeku Aneke ruled in favor of Rida National Plastics, finding the tariff increase in violation of Section 51 of the Electricity Act, 2023. The injunction restricts Ikeja Electric and NERC from applying or implementing the disputed tariff on the company’s electricity supply.

Additionally, the court prohibited the defendants from demanding a N20 million balance on the purported electricity bill dated May 4, 2024, and from disconnecting Rida National Plastics’ electricity supply due to non-compliance with the tariff.

The case has been adjourned until July 9, 2024, for further hearing. This ruling marks a significant victory for Rida National Plastics and a setback for Ikeja Electric and NERC.
