BREAKING: What Court Of Appeal In Lagos Did To Election Of Senator Tony Nwoye Of Labour Party Challenged By Stella Oduah
The Court of Appeal in Lagos has dismissed Stella Oduah’s appeal contesting the victory of Tony Nwoye of the Labour Party in the February 25, 2023 Anambra North Senatorial District election.

The National Assembly Election Petition Tribunal in Awka, Anambra State, had previously dismissed Oduah and the Peoples Democratic Party’s petitions on September 6, citing a lack of merit.

Unsatisfied with the tribunal’s ruling, Oduah and the PDP filed appeals marked CA/AW/EP/SEN/AN/03/2023 and CA/AW/EP/SEN/AN/04/2023 with the Court of Appeal.

According to the Independent National Electoral Commission, Nwoye secured 94,779 votes, while Oduah had 50,146 votes.
Oduah, a former aviation minister, represented Anambra North for eight years.
However, the Appeal Court ruled against Oduah on the issue of nomination. It emphasized that the nomination of candidates falls within the internal affairs of a political party and is not subject to legal action.
The Court also categorized the nomination as a pre-election matter, asserting that Oduah lacked the standing to challenge the Labour Party’s membership.
It stated that only an aspirant in the primary election could raise such issues.
In October, the Appeal Court in Lagos reserved judgment in the appeals filed by Oduah and the PDP.
The three-member panel of justices adjourned for judgment after hearing arguments from counsel for the parties.
