The detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has lodged an appeal at the Appeal Court challenging the criminal charges brought against him by the Nigerian government. In the notice of appeal submitted to the Appeal Court, Kanu’s legal team asserted that the lower court violated his constitutional right to a fair trial. They argued that the Department of State Services (DSS) failed to provide adequate facilities for Kanu’s defense and impeded his right to choose legal representation, leading to a miscarriage of justice.

The appeal, registered under charge No: FHC/ABJ/CR/383/2015, outlined the grounds for contesting the trial court’s decision and sought remedies from the Appeal Court. Kanu’s legal representatives emphasized the importance of ensuring fair trial procedures, including the provision of adequate facilities for defense preparation and the right to counsel.

Additionally, the legal team criticized Justice Nyako’s stance that the court cannot dictate the operational methods of security agencies. They argued that Kanu’s constitutional rights must be safeguarded, including access to legal counsel and preparation of defense materials. Kanu’s lawyers urged the appellate court to intervene and halt the unconstitutional practices of the authorities.

Moreover, Kanu’s legal team objected to Justice Nyako’s directive for accelerated proceedings, highlighting the government’s consistent denial of Kanu’s rights to defense preparation and legal counsel. They asserted that a fair trial cannot proceed under such circumstances and called for corrective action to prevent further miscarriages of justice.

In light of these arguments, Kanu’s legal representatives urged the Appeal Court to uphold the rule of law and ensure that Kanu’s constitutional rights are respected throughout the legal proceedings.
