Teenager Detained Over Mother’s Debt, Takes EFCC To Court

Arrested by EFCC operatives from the Lagos zone on April 26, 2024, Oluwateniola was taken into custody from her school premises due to a debt her widowed mother, Mrs. Omoniyi Omidiji, allegedly owed to a business partner, Mr. Charles Nwoko, from a transaction in 2020.

In a fundamental rights suit filed at the Federal High Court, Lagos, Oluwateniola alleges that she was detained unlawfully over her mother’s debt. The debt in question stems from an investment of N100,000,000 into Mrs. Omidiji’s business, Elisto Global Services Limited, in which Oluwateniola is named as a director.

Despite being a minor at the time the business deal was made, Oluwateniola has been held responsible by the EFCC, who maintain that she should answer for her mother’s actions in the joint venture with Mr. Nwoko.

Her lawyer, Chijioke Emeka, SAN, argues that Oluwateniola’s fundamental human rights have been violated, as she was a minor when her mother entered into the partnership with Mr. Nwoko. Emeka is seeking enforcement of her rights to human dignity, personal liberty, fair hearing, and freedom of movement, and is demanding N10,000,000 in damages.

Efforts to reach the head of Media and Publicity of the EFCC, Dele Oyewale, for comment were unsuccessful, and a date for further hearing on the matter is yet to be fixed.
