Why El-Rufai Remains in Detention 200 Days After His Arrest

Former Kaduna State Governor, Nasir El-Rufai, has spent 200 days in detention amid multiple legal proceedings involving allegations of financial misconduct and the alleged unlawful interception of telephone communications belonging to National Security Adviser, Nuhu Ribadu.

According to Ireporter Online, El-Rufai’s prolonged detention has generated legal and political controversy, with his family and political associates raising concerns about the duration and conditions of his custody, while the relevant agencies maintain that the cases are being handled in accordance with the law.

The former governor’s current legal challenges stem partly from a 2024 report by the Kaduna State House of Assembly, which raised allegations concerning the management of the state’s finances during his tenure between 2015 and 2023. The lawmakers alleged that about ₦423 billion was mismanaged and called for investigations into El-Rufai and some officials who served under his administration.

Following the development, the Economic and Financial Crimes Commission (EFCC) invited El-Rufai for questioning. He honoured the invitation on February 16, 2026, and was subsequently detained at the commission’s Abuja headquarters.

El-Rufai was later transferred to the Independent Corrupt Practices and Other Related Offences Commission (ICPC), which instituted separate proceedings against him over allegations linked to his tenure as governor.

The ICPC has accused the former governor of offences including alleged conversion and possession of proceeds of corruption and money laundering. El-Rufai has pleaded not guilty and has consistently denied wrongdoing.

A separate case was also instituted by the Department of State Services (DSS) over allegations relating to the unlawful interception of Ribadu’s telephone communications. El-Rufai has disputed the allegations and maintained his innocence.

His continued detention has also been affected by bail proceedings in the various cases. Although courts have granted bail in some of the matters, stringent conditions were imposed, which his legal team has challenged as difficult to fulfil.

In one of the proceedings, a Federal High Court in Kaduna granted El-Rufai bail subject to a ₦200 million bond and two sureties in like sum, alongside other conditions including the surrender of his international passport and restrictions on his movement.

In the separate Abuja case, his lawyers also raised concerns over the conditions attached to his bail.

El-Rufai was briefly released from custody in March following the death of his mother in Cairo, Egypt, to enable him to attend her funeral. He subsequently returned to custody.

Concerns have also been raised by his family and associates over his health and access to medical care while in detention. The ICPC has rejected allegations that it deliberately denied the former governor appropriate medical attention, insisting that it facilitated authorised medical consultations when necessary.

The commission also accused El-Rufai of allegedly breaching conditions attached to one of his medical visits, an allegation disputed by his camp.

The former governor has since filed a fresh ₦10 billion fundamental rights suit against the ICPC over alleged restrictions on visits by members of his family and other concerns regarding his treatment in custody.

Meanwhile, his Abuja case involving the alleged interception of Ribadu’s telephone communications is scheduled to resume on September 22, 2026, for the adoption of his no-case submission.

As El-Rufai marks 200 days in custody, the various legal proceedings against him remain unresolved. He continues to deny the allegations, while the agencies prosecuting or investigating the cases maintain that they are acting within the law.
