BREAKING: What Appeal Court Did To Labour Party’s Ireti Kingibe Election As FCT Senator
On Wednesday, the Court of Appeal in Abuja rejected the appeal filed by former Senator Philip Aduda of the Peoples Democratic Party (PDP) contesting the election of Senator Ireti Kingibe, who represented the Federal Capital Territory (FCT) under the Labour Party.

The judgment, delivered via Zoom, found Aduda’s appeal lacked merit and subsequently dismissed it.

The Independent National Electoral Commission (INEC) Returning Officer for the FCT senatorial election, Prof. Sani Saka, had declared Kingibe the winner with 202,175 votes, surpassing Aduda’s 100,544 votes, securing him second place.
Aduda and his legal team then brought their case to the National Assembly Election Petitions Tribunal in Abuja, contesting Kingibe’s victory.
They claimed that the collation of results across the FCT area councils was incomplete when Kingibe was declared the winner.
However, the Tribunal dismissed Aduda’s petition, asserting it lacked merit, and upheld Kingibe’s victory in the February 25, 2023 polls.
Dissatisfied with the tribunal’s decision, Aduda’s legal team sought recourse in the Court of Appeal, aiming to overturn the tribunal’s judgment.
In response, Kingibe, represented by her legal team, argued that Aduda’s petition had been rightly dismissed and urged the appellate court to uphold the tribunal’s ruling.
In its verdict delivered on Wednesday by Justice Daniel Kahiru, the Court of Appeal ruled that Aduda failed to present the Bimodal Voter Accreditation System (BVAS) machine data and voter register as evidence to substantiate the claims of irregularities in the election process.
The court also determined that the appellants did not provide sufficient evidence of overvoting. Consequently, the court affirmed Ireti as the rightful winner, stating, “All the issues in this appeal are resolved against the appellant.”
