BREAKING: What Appeal Court Just Did To Ned Nwoko’s Election

The Court of Appeal in Asaba has affirmed the removal of Senator Peter Nwaoboshi as the senator-elect for Delta North Senatorial District.

Justice Olubunmi Oyewole, delivering the verdict via Zoom on Wednesday, characterized Nwaoboshi’s appeal as lacking in merit.

Back in April, the Federal High Court Abuja had dismissed Nwaoboshi as the senator-elect for Delta North Senatorial District. This came as a result of a lawsuit filed by Mr. Ned Nwoko contesting Nwaoboshi’s candidacy as the representative of the Peoples Democratic Party in the party’s primaries on October 2, 2018, in Delta.

The court ruled that Nwaoboshi, a current senator, was not the validly elected candidate of the PDP in the primary election. Consequently, Justice Mohammed ordered the Independent National Electoral Commission to announce Nwoko as the PDP candidate, having demonstrated before the court that he garnered the highest number of votes in the aforementioned primary election.

Furthermore, in September, the National and State Houses of Assembly Election Tribunal in Asaba, Delta State, rejected a petition from the All Progressives Congress (APC) against Nwoko, which had been filed by Senator Nwaoboshi. The Tribunal imposed a penalty of N500,000 on the petitioner.

In the case numbered CA-AS-EP-SEN-DL-36-2023, Nwaoboshi lodged an appeal against the tribunal’s ruling, with INEC and Ned Nwoko Chinedu Munir named as the Respondents.

Reading the ruling of the Appeal Court on Wednesday, Justice Oyewole said, “The Appeal is against the decision of the National Assembly Election Tribunal, Asaba where it dismissed the Appellant’s petition against the return of the second Respondent for the Delta North Senatorial District in the National Assembly.

“The court considered all the arguments canvassed by the parties on the issues and came to the conclusion that the appeal is devoid of merit and is accordingly dismissed.

“Although in this regard, the court did not award any cost and appreciated the industry put in by various counsel in respect of the various briefs.”

“Appeal dismissed,” Justice Oyewole added.
