During the court session, petitioners Muritala Ajaka and SDP steered away from their initial claims against Governor Usman Ododo, accusing him of age declaration affidavit forgery, after their key witness revealed that he was not present in Kogi State during the election.

The witness, identified as Dan Musa Williams from the Federal Capital Territory High Court in Abuja, asserted that the documents in question did not originate from the Court. However, upon cross-examination, he failed to provide substantial evidence to support his assertion.

When questioned about his investigation into the authenticity of the documents through registry records, the witness admitted to merely checking the date, which happened to be a Saturday, and concluded that they couldn’t have originated from the Court.

It later emerged that the ‘declaration of age’ affidavit was sworn to in Okene, Kogi State, not in the FCT as initially claimed.

The witness alleged that a lawyer had sent him the document in question, but confusion ensued when he stated his belief that the affidavit provided by the APC candidate was counterfeit due to the absence of the deponent’s name and photo.

However, upon being directed to an affidavit submitted to the Independent National Electoral Commission (INEC) that included both the deponent’s picture and name, the SDP witness acknowledged that it was sworn in Okene, not in the FCT.

The inconsistencies between the witness’s testimony in Court and the evidence presented to the Tribunal led to a halt in the proceedings, with no further clarification provided by the witness.

As a result, the Tribunal has adjourned the continuation of the hearing until March 30, 2024.
