According to reports from Ireporteronline, the NBA Kano Branch acknowledges the constitutional authority of both the legislative and executive arms of the state government—the State House of Assembly to enact laws and the Governor to assent to them. Gezawa emphasized that once legislation is signed into law, it must be implemented by state mechanisms and enforced by competent courts.

However, the NBA strongly criticized the involvement of military forces in enforcing these legal decisions, condemning it as a distressing reminder of military dictatorship. Gezawa stressed that the enforcement of court orders should be conducted exclusively by civil authorities, in accordance with the Sheriff and Civil Processes Act, rather than by the military.

The legal body outlined the proper procedures for enforcing court orders, including notifying individuals with Form 48 and escalating to Form 49 in cases of non-compliance. These steps are essential for ensuring due process and upholding legal fairness, which are fundamental to maintaining the rule of law.

Gezawa’s statement also appealed to all state actors to honor their oaths of office and operate within the confines of their official duties to prevent undermining the judiciary. He expressed concern that deviating from these boundaries could jeopardize the peace and security of Kano State.

The statement from the NBA Kano Branch comes amidst escalating tensions following the state government’s decision to depose Aminu Ado Bayero, the 15th Emir of Kano. Former emirs and other deposed officials were given 48 hours to vacate their palaces following the repeal of the law that structured the emirate.
