The recent dismissal of an appeal by former Local Government chairmen in Imo State has sparked reactions across Nigeria, particularly in legal and political circles. Led by Justice Sadiq Abubakar Umar, the five-member panel reaffirmed the Court of Appeal’s ruling from the Owerri division, which had upheld the trial court’s stance that the suit constituted an abuse of court process due to a similar ongoing case involving the same parties and issues.

Imo State’s Attorney General and Commissioner for Justice, C. O. C. Akaolisa (SAN), who was present during the judgment, expressed satisfaction with the Supreme Court’s decision. Akaolisa highlighted that the ruling paves the way for the state to proceed with Local Government elections, a crucial step awaited by the state government.

“The state government decided to await the Supreme Court’s decision in this case before conducting Local Government elections,” Akaolisa stated, emphasizing the government’s respect for the judicial process. He added, “Today, the court has dismissed the action filed by the former Chairmen, contending their tenure. The state is now free to conduct Local Government elections.”

The legal saga dates back to the tenure of former Governor Rochas Okorocha, who had replaced elected Local Government Chairmen with appointed Transitional Committee Chairmen in 2011. This action prompted legal challenges from the ousted chairmen, leading to multiple court battles spanning several years.
