The court proceedings, presided over by Justice Adeniyi Familoni, unfolded with the defendant facing a single count of murder. According to the charge, Arowolo Sunday committed the crime on April 9, 2021, at Ikogosi within the court’s jurisdiction.
The prosecution, led by Oluwaseun Olasanmi, presented a compelling case, calling seven witnesses and submitting various exhibits, including the defendant’s statement, pictures of the deceased, and a death report.
The harrowing details of the crime emerged through the testimony of the deceased’s 15-year-old son, who witnessed the tragic incident. The young witness recounted the chilling moment when Arowolo Sunday ambushed his father, using a large iron trap and a wooden pestle to inflict fatal injuries. Despite the son’s attempts to seek help, the villagers hesitated to confront the assailant, citing fear of reprisal.
In his defence, Arowolo Sunday, represented by counsel, presented two witnesses, but the court found the evidence overwhelmingly in favor of the prosecution. Justice Familoni, in delivering the verdict, expressed satisfaction that the prosecution had conclusively proven the elements of the alleged murder beyond a reasonable doubt.
With a heavy heart, Justice Familoni pronounced the sentence, stating, “The sentence of this court upon him is that he be hanged by the neck till he be dead, and may the Lord have mercy on your soul.” The solemn pronouncement marked the culmination of a tragic chapter, providing a sense of closure for the grieving family and reaffirming the court’s commitment to justice.
