AGF Takes Over Terrorism Trial of Fubara’s Loyalists, Sparks Concern
The Minister of Justice and Attorney General of the Federation (AGF), Lateef Fagbemi (SAN), has directed the Inspector General of Police (IGP) to transfer the terrorism trial of five loyalists of Governor Siminalayi Fubara of Rivers State to the Federal Ministry of Justice. The trial, involving the five defendants accused of complicity in the burning of Rivers State House of Assembly and the killing of a Divisional Police Officer, has been under the jurisdiction of the police. However, Fagbemi’s decision to take over the case signifies a significant shift in authority and oversight.
During the court session presided over by Justice Mobolaji Olajuwon, the AGF revealed that he had not effectively assumed control of the trial due to the IGP’s delay in transferring the case file. Consequently, an adjournment was sought to allow the Police Chief to comply with the directive and for proper review of the defendants’ indictments.
While the delay was attributed to administrative hurdles by the IGP’s lawyer, Simon Lough (SAN), the judge emphasized the importance of adherence to the AGF’s directive. As a result, the trial’s resumption was postponed to May 7, 2024, with the defendants ordered to be returned to Kuje prison in Abuja for continued remand.
The decision to transfer the trial to the AGF’s office underscores the need for clarity in the administration of justice and raises questions about the independence of the judiciary and law enforcement agencies. It also highlights the complexities surrounding terrorism cases and the role of various stakeholders in ensuring fair and transparent legal proceedings.
