KC Luxury Sues NDLEA, Demands ₦190m Over Alleged Unlawful Detention

Socialite and businessman Afolabi Kazeem Michael, popularly known as KC Luxury, has filed a fundamental rights enforcement suit against the National Drug Law Enforcement Agency (NDLEA) at the Federal High Court in Lagos, demanding ₦190 million in damages over his continued detention.

According to Ireporter Online, Michael is challenging what he described as unlawful arrest and detention, invasion of privacy, and the alleged distribution of photographs and videos of him while in the custody of the anti-drug agency.

KC Luxury was arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport in Lagos while reportedly preparing to travel to Paris.

The NDLEA had linked his arrest to an ongoing investigation involving the seizure of 184.50 kilogrammes of cocaine allegedly connected to an international drug trafficking network using Nigeria as a transit route for consignments destined for the United Kingdom, Europe and Asia.

The agency also reported that its investigation resulted in the seizure of foreign currencies and luxury items, alongside searches conducted as part of the operation.

However, in the suit filed through his lawyer, Abdulakeem Labi-Lawal (SAN), KC Luxury challenged his continued detention, arguing that he had not been formally charged with a criminal offence.

He is asking the court to declare his detention unconstitutional and a violation of his fundamental right to personal liberty.

In an affidavit sworn by his father, Eric Afolabi, the family alleged that KC Luxury had spent 14 days in NDLEA custody without being informed of the specific offence for which he was being detained or brought before a court.

The affidavit further alleged that NDLEA operatives searched his residence at Movamo Court, Banana Island, Lagos, after his arrest without presenting a search warrant. According to the family, the search did not yield any incriminating material.

KC Luxury is seeking an order directing his immediate release or granting him bail on appropriate terms pending the filing of any criminal charges against him.

Justice Friday Ogazi, however, declined to grant the application on an ex parte basis and directed that the NDLEA be served with the suit to allow the agency to respond.

The judge also ordered the agency to produce KC Luxury in court at the next hearing and directed that the relevant documents be served within four working days, while its response is to be filed within five days of service.

The case has been adjourned until September 9, 2026, for hearing of the substantive application.

The allegations contained in the suit remain claims by the applicant and have not been determined by the court.
