Escalating Legal Conflicts Amid Fubara And Wike’s Confrontation In Rivers State

The legal saga began on November 1, 2023, when a Rivers State High Court issued a restraining order against the State House of Assembly and the Chief Justice, preventing them from impeaching Governor Siminalayi Fubara. This move was aimed at temporarily halting the impeachment proceedings initiated against Fubara by the state legislative arm.

Subsequently, on December 18, 2023, 25 lawmakers loyal to Nyesom Wike approached a Federal High Court in Abuja seeking legal backing to continue serving as lawmakers despite defections from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC). This action further fueled tensions, prompting President Bola Tinubu to convene a peace meeting in Abuja. However, the resulting Presidential Proclamation only exacerbated the disagreements, leading to additional litigation.

The Rivers State Elders and Leaders Forum contested the legitimacy of Tinubu’s peace proclamation, sparking further legal battles. Meanwhile, the Rivers State Civil Society Organization filed a lawsuit seeking to oust lawmakers who defected from the PDP to the APC and prevent Fubara from presenting the 2024 budget to them.

In a separate legal maneuver, plaintiffs challenged the legality of Tinubu, Fubara, and the Rivers State Assembly’s agreement to nullify or undermine constitutional provisions. This culminated in a recent court ruling that declared the seats of lawmakers loyal to Wike vacant pending further legal proceedings.

Justice Charles Wali issued an interim injunction in response to a lawsuit filed by Speaker Victor Oko Jumbo and others, further deepening the political crisis in Rivers State.
