Impeachment: Ondo Deputy Governor Loses In Court

Ondo State Deputy Governor, Lucky Aiyedatiwa, faced a setback in his efforts to halt his impeachment proceedings initiated by the State House of Assembly.

An Akure High Court dismissed the suit he had filed, contesting the Assembly’s move to impeach him. Justice Oluyemi Akintan-Osadebay, presiding over the case, ruled that the court lacked jurisdiction to prevent conflicting decisions with an Abuja Federal High Court.

The judge emphasized that it was an improper use of the legal system to pursue the same case simultaneously in both Akure and Abuja High Courts.

Aiyedatiwa had filed the suit AK/348/2023 on September 25, 2023, to thwart the House of Assembly’s impeachment efforts.

He had also lodged another case at the Abuja Federal High Court, where he obtained an interim injunction on September 26, prohibiting the House from impeaching him on grounds of alleged gross misconduct.

The interim injunction granted by Justice Emeka Nwite on September 26 had expired on October 10. Femi Emodamori, counsel to the House of Assembly, confirmed this development, stating that the Chief Judge of Ondo State, Justice Olusegun Odusola, can now proceed with constituting the panel as directed by the House of Assembly.
