Ojukwu’s Estate: Court Finally Delivers Ruling In Suit Filed By Bianca In 2012
The Lagos High Court, Ikeja, has issued a favorable judgment in favor of Bianca Ojukwu, the widow of the late Igbo leader and Ikemba Nnewi, Dim Chukwuemeka Odumegwu Ojukwu, and their children concerning the management and control of some assets of Ojukwu Transport Limited (OTL), which was the family company where her husband served as a director before his passing.
The lawsuit, filed by Bianca in 2012 on behalf of her two infant sons, Afamefuna and Nwachukwu, was against OTL and seven others, including brothers of the late Dim Ojukwu, their sons, and a property agent. The suit was based on the alleged attempt by some of the defendants to forcibly take possession of their residence at No. 29 Oyinkan Abayomi Drive, Ikoyi, Lagos, and some of the company’s properties in Lagos that were under the management and control of their late father.
The court ruled in favor of the claimants, stating that they, being the biological children of the late Dim Ojukwu, are entitled to their father’s estate and his entitlements as a deceased director and shareholder of OTL. The judge emphasized that as a court of equity, it would not permit the dispossession of the claimants, who are children of a founding director of the company, while other directors maintain control and benefit from other properties owned by the company.
The court declared that the claimants have the right to possess and control the assets that their late father managed and controlled in the company while he was alive. The court also noted that the fact that the company allowed the family to continue living in and deriving income from its assets over the years was a decision of the company by conduct.
The counterclaims filed by the defendants were dismissed for lack of competence, and the court further declared that the claimants have the right to possess and occupy the property known as No. 29 Oyinkan Abayomi Drive, Ikoyi, Lagos, until the management of OTL’s assets is harmonized. The court ruled that any threat of forceful eviction of the claimants from the said property by the defendants is illegal.
