The Abuja Court of Appeal has rejected the appeal lodged by Mr. Sani Yahaya of the New Nigeria Peoples Party (NNPP), challenging the election victory of Kefas Agbu, the Peoples Democratic Party (PDP) candidate, in the Taraba state governorship election.

Yahaya and the NNPP contested the outcome of the March 18 governorship election, citing non-compliance with the Electoral Act and alleging that Agbu did not secure the majority of lawful votes.

However, the appellate court, in its judgment delivered on Tuesday, deemed the reliefs sought by the NNPP candidate inconsistent. The court pointed out the contradiction in faulting the election results based on non-compliance with the Electoral Act while simultaneously requesting to be declared the winner of the same election.

In a unanimous decision, the court dismissed the NNPP’s appeal, deeming it without merit, a stance consistent with the Tribunal’s decision on September 30.

Governor Agbu secured victory in the March 18 Governorship Election with 257,926 votes, surpassing Yahaya, who received 202,277 votes.

The petitioners, citing non-compliance with the Electoral Act 2022, had filed a petition against the PDP’s triumph, alleging overvoting, mutilation of results sheets, and reported violence in certain polling units.
